Funny, because if that rule actually applied then anybody could implement Phoenix into their core with permission from the free allegiance community.. which would violates the agreement Noir most assuredly has with the person he liscensed his models/textures from.

Yet another reason why those rules need to be rethought.

Those rules were around for quite some time, most likely before the introduction of Phoenix. Yes, according to those rules we could use the faction in any core.
