Seems it was not the other overlay program i used to record allegiance that made Alleg crash.
The new mumble client itself has a bug.
1) download new current mumble.. 1.2.3 or 1.2.3a
2) configure > settings > overlay > enable overlay, other settings didnt matter there
3) launch alleg, and alleg just crashed. No matter if i had any other overlay or record program closed or opened.
For me the widely suggested argument fix -nod3d9ex did not work.

Downgrading worked.

I took 1.2.2, it has less options in overlay settings, but it has not crashed alleg so far.
And my other overlay program works simultanously.
Googling this issue is pointless, most people say mumble brakes this or your other overlay brakes that.
PS: for newer games.. x64 or directx11, mumble might have no overlay..
this however is not the case for allegiance..
