I don't think this is a legal issue for us. We didn't distribute the software, so *if* it's illegal, it's not *our* problem, but the distributer. If the distributer stole "our" version, we could address him on this matter.

I agree, it would be a problem if they distributed the old non-working version of Alleg. But, we will know soon enough.

You would think if they were mass producing the installation files for Allegiance they would have at least dropped us a line about it?

If Understand what they are doing, that is putting the software install files on a CD as free programs, they are in no way that I can see violating anything in the above paragraph. It might be different if the CD was the sole reason people buy that magazine, that would be the only way M$ could try and put preasure on them by persueing the avenue that people buy the magazine because of the CD, but more importantly because Allegiance is on it. They can easily retort that since the files are readily downloadable for free, so people wouldn't want to pay for what they can get for free. But who knows.

Well first, I think that's incorrect. They're using it as part of a promotion in order to sell magazines. Magazine A has no CD, Magazine B has the same content but also includes the CD - which do you buy?

In any case, we have terms in our ToS that basically say that they shouldn't be redistributing the software anyway. So MS decided that the magazine had done wrong, it was a) against our ToS and b) without our permission.

To answer Ozzy's point - they didn't even contact us to ask if they could do it.

I can't find the magazine with the CD locally. And as Pook pointed out we have no liability here. My gut tells me all they are giving away is a copy of the source code.

Agreed carbon, but that is not all! We also get to create some needless copyright drama for the best game barely anyone plays! Awesome!
