There's also the vc that are clips of Alien and whatever aftermarket stuff (Z chatpack). I can't remember what the time limit is on clips, I know you don't have to pay a royalty if the clip is under a certain time, however placing them in a video game maybe different. Were the Alien VC in the original MS build or were they introduced at a later time?

Then there's the sw core.... lol.

MrChaos wrote:QUOTE (MrChaos @ Mar 25 2015, 05:47 PM) Oh and I have seen discussions about Noir buying ship models and seen a site selling them with my own eyes. IIRC they all cost him lesd than a 100 USD. Cannot reproduce the trial if you need more than my words but maybe SgtBaker can do it. If I understand right that means they have to go. I got an old couch ;)
It was this: http://3drt.com/store/vehicles/sci-fi-airspace-pack.html.

I vaguely remember Noir implying he either knew the guy personally and/or commissioned all or part of the Phoenix models. The miner model in particular smacks of a one-off as it is still sold individually.

All the textures I made (asteroids, some environments, rix int, etc.) used source material from:
Mayang texture library - free for any commercial use besides being included in a competing commercial texture library. Even then they only are concerned if the changes were minor.http://photojournal.jpl.nasa.gov/ - the images I referenced should all be available for commercial use under http://www.jpl.nasa.gov/imagepolicy/.
Fun fact: for each of the different types of asteroids I largely tried to stick with NASA images from a specific celestial body. I will mail a cookie to the first person to identify where the Uranium and Carbon rocks come from.

They also tacitly encourage it so that people get used to using their products, with the end goal of encouraging those people to demand those products at their businesses, universities, etc. Places that really do need to worry about having legitimate copies of those products and will pay handsomely for the rights so they don't get sued up the ass.

If Windows 10 has a store or something that I didn't know about that allows people to pay Microsoft directly for purchases, well, even better.

Also, haven't had the opportunity to say this yet, but GO CASHTO!!!!!
You should try working in countries like brazil, china, or any "low tier" country.

Probably 20% of their products are original.

Not even the government bothers buying legit copies. They aquire 10 licenses and install the product over 30 machines.

Also your individual level is like 75%+ of the country population.

Yes! i am old and very demanding and she left me :)
ohh i am in la la land

Nix1 :The thing old-timer business folks like you often miss is that "Free" is not the same as "No expected value."

old people like me go fishing with live bait, we catching more fish that way and a good mouse trap is the one that use real cheese
if not for us old people, you would not enjoy the fruit of our labor .

now let get back to free copy right..Mr nix1 and Mr cashto where is our allegiance free copy right ?
how long would it take for you two to obtain those free copy right ?
why take so long ? if thing were free why it's so hard for you to get it ?
come on, let make it happen if i am not happy, you two are not happy.. :)

as nix1 and cashto know, old timer business folks like us hold the copy right, we been playing the game too long if we don't like what we see, we have the right to change the rules
now, can we do something within our control, be nice to new players, what i am asking is little bit too much.. war game and be nice is like oil and water.. they don't mix..just try

i want to apologies to all who read this post, i will be more productive from here on

cashto wrote:QUOTE (cashto @ Mar 25 2015, 10:10 PM) BTW, in the unexpected event that we can get Allegiance relicensed, we need to scrub the game and remove any other intellectual property that we don't know for certain that we own or have rights to, before we can put it on Steam.

I'm looking at you, Sobe lizards faction. Also I know the Phoenix models came from somewhere, we'll need to look at that license to make sure there is no noncommercial use clause or anything else that could cause a problem.

Anything else? Ambient noises? Images? Code contributions that didn't come from FAO?
What's the 'legal' status of our code contributions ? do we (the devs who contributed) have a say in what will happen with the game if MS re-license it ?

What about tools like ICE or AMT ? Major changes were made to the game with these tools. Are they part of the 'game' or considered external ?

IANAL, obviously, but I believe the devs would be considered joint authors of a collaborative work from a copyright perspective, so they would share ownership jointly and equally, so absent an agreement to the contrary, any one of them can grant permission to use the work to third parties without the consent of the other owners. What matters is the intent of the contributors at the time of creation.

That may not be terribly easy to prove in a court of law (again, I wouldn't know), because FAO is a rather amorphous entity, and we've never required developers to sign any ownership agreement before accepting their contribution, but an oral agreement is as much legally valid as a written one, just harder to prove.

ICE and AMT would probably be considered separate works from the Allegiance game. You would retain ownership, but not ownership of maps, cores, etc. created with the use of those tools. I don't think there you would have any say as whether those maps, cores, etc. could be sold, as there was no end-user license agreement or contract in place limiting the use of AMT and ICE at the time.

Maps and cores would be in the same boat -- separate works. PCore has gone through a lot of hands since MS1.25, and we might have an issue there. I don't worry about P1 or P32, and CC was a collaborative work, but they're all based on DN and we never did get Noir's permission to fork, did we? In theory he could show up and demand us to take down his or any core based on it.
